DMCA & Copyright Policy

Opengift Group LLC respects the intellectual property rights of others and expects users of its platform to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we have designated a compliance channel to process notices of alleged copyright infringement.

1. Zero-Knowledge logistical notice

As Opengift Group LLC operates an End-to-End Encryption (E2EE) framework, our server administrators can only store encrypted data blobs and cannot view, preview or manually scan user-uploaded files. We do not have the technical ability to review copyrighted material unless you provide the unique gift URL and corresponding Security PIN to allow local browser-side decryption.

2. How to submit a takedown request

If you believe your copyrighted work has been copied and uploaded to our platform without authorization, send a formal DMCA notice to our legal department at legal@opengift.llc containing:

A physical or electronic signature of the copyright owner or authorized representative.
Identification of the protected work alleged to have been infringed.
The exact gift URL (including the Security PIN needed to decrypt and access the specific infringing experience).
Your physical address, phone number and official contact email.
A statement that you believe in good faith that the use of the material is not authorized by the copyright owner, their agent or the law.
A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

Upon receiving a valid and fully documented notice, Opengift Group LLC will immediately remove the corresponding database token and fully block access to the encrypted file.

3. Counter-notification

If you believe your content was removed in error, you may send a counter-notification to legal@opengift.llc containing:

Your physical or electronic signature.
Identification of the removed content and the URL where it appeared.
A statement under penalty of perjury that you believe in good faith the content was removed by mistake or misidentification.
Your name, address and phone number, and consent to the jurisdiction of the federal district court of Wyoming.

4. Repeat infringers

In appropriate circumstances and at our sole discretion, Opengift Group LLC will terminate accounts of users who are repeat copyright infringers.
