These Terms of Service ("Terms") govern your access to and use of the website located at https://www.opengift.ai (the "Website"), as well as any interactive gift experiences, 3D world maps, digital albums, customized software, or cryptographic automation services provided by Opengift Group LLC (collectively, the "Services"). By accessing, browsing, creating an account, or using our Services, you acknowledge that you have read, understood, and explicitly agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately cease all access.
The Services are owned, maintained, and operated exclusively by Opengift Group LLC, a single-member limited liability company organized and existing under the provisions of the Wyoming Limited Liability Company Act, United States.
Pursuant to Article IV of our core operating provisions and state legislation, the liability of the member, managers, and authorized signers is strictly limited to the fullest extent permitted under Wyoming law. The personal assets of the single member are shielded, and any operational defaults or liabilities remain solely an obligation of the corporate entity.
To guarantee absolute user privacy, Opengift Group LLC deploys a decentralized, Zero-Knowledge End-to-End Encryption (E2EE) framework driven by the browser's native Web Crypto API.
You must be at least 13 years of age to access the Website or use our services. If you are between 13 and 18 years of age, you may only use the platform under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
You are entirely responsible for safeguarding your localized encryption parameters, access links, and account security PINs. Since Opengift Group LLC operates a Zero-Knowledge architecture, our support team cannot retrieve, recover, or reset a lost encryption key or Security PIN. Lost keys result in permanent data loss.
Users strictly agree not to attempt to:
All intellectual property rights, including source code, UI designs, proprietary algorithms, 3D visualization systems, graphics, and the "Opengift" branding remain the sole property of Opengift Group LLC. Nothing in these Terms transfers any ownership or title to the user.
You retain full copyright ownership of your uploaded media, photos, messages, and other content. By submitting content, you grant Opengift Group LLC a worldwide, non-exclusive, royalty-free hosting license solely to store, process, and transmit your encrypted data chunks to deliver the interactive gift services to you and your designated recipients. We do not use your content for advertising, AI training, or any purpose beyond operating the Services.
You may not submit content that is unlawful, defamatory, obscene, hateful, or threatening; that depicts or encourages violence or self-harm; that contains malware or malicious code; or that infringes any third-party intellectual property or privacy rights.
OpenGift is designed exclusively for the use of real, authentic personal photographs. By submitting any image to the Services, you explicitly confirm and warrant that:
You represent and warrant that you hold all necessary rights, licenses, consents, and permissions to upload, share, and use any image, photo, or other content you submit to the Services. OpenGift Group LLC does not pre-screen, review, or verify the copyright status, intellectual property ownership, or licensing terms of user-submitted content prior to storage.
BY UPLOADING ANY IMAGE OR CONTENT TO OPENGIFT, YOU ASSUME FULL AND SOLE LEGAL RESPONSIBILITY FOR ANY COPYRIGHT INFRINGEMENT, INTELLECTUAL PROPERTY VIOLATION, RIGHT OF PUBLICITY CLAIM, OR UNAUTHORIZED USE OF THIRD-PARTY MATERIAL. THIS INCLUDES, WITHOUT LIMITATION, PHOTOGRAPHS OF CELEBRITIES, PUBLIC FIGURES, ATHLETES, MUSICIANS, OR ANY OTHER IDENTIFIABLE PERSON OR ARTWORK FOR WHICH YOU DO NOT HOLD THE NECESSARY USAGE RIGHTS. OPENGIFT GROUP LLC BEARS ABSOLUTELY NO LIABILITY WHATSOEVER FOR ANY COPYRIGHT DISPUTES, DMCA TAKEDOWN CLAIMS, INTELLECTUAL PROPERTY ENFORCEMENT ACTIONS, OR LEGAL PROCEEDINGS OF ANY KIND ARISING FROM CONTENT UPLOADED BY USERS. ALL SUCH LIABILITY RESTS EXCLUSIVELY AND ENTIRELY WITH THE UPLOADING USER.
If you receive or are subject to a copyright claim related to content you uploaded, you agree to indemnify and hold harmless Opengift Group LLC, its member, officers, agents, and technical partners from any resulting claims, damages, costs, or legal fees. DMCA takedown requests may be submitted to legal@opengift.llc or via our dedicated DMCA Policy page.
All transactions are processed in United States Dollars (USD) through secure, PCI-DSS compliant third-party gateways. Prices are subject to adjustment at the sole discretion of management; changes will not affect orders already completed.
Due to the instantly provisioned and customized cryptographic infrastructure of our digital interactive experiences, all transactions are final and non-refundable. The instant allocation of server resources, 3D rendering processing, and decentralized encryption deployment cannot be reversed or returned.
If you experience a verifiable server failure or application error that permanently prevents service delivery, you may open an inspection file with our accounting desk at finance@opengift.llc within 14 days of the transaction. If a core technical anomaly on our servers is verified, Opengift Group LLC will issue a full purchase credit or payment reversal at our discretion.
You are responsible for any applicable taxes (including VAT, GST, or sales tax) imposed by your jurisdiction. Where required by law, Opengift Group LLC may collect and remit such taxes.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, STATUTORY, OR IMPLIED. OPENGIFT GROUP LLC EXPLICITLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE PERPETUALLY UNINTERRUPTED, SECURE, OR COMPLETELY ERROR-FREE.
TO THE MAXIMUM EXTENT AUTHORIZED BY LAW, IN NO EVENT SHALL OPENGIFT GROUP LLC, ITS MEMBER, AGENTS, OR THIRD-PARTY TECHNICAL PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. THE COMPANY'S AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE TOTAL NOMINAL FEES PAID BY YOU TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
These Terms and any legal conflict emerging from the use of the platform shall be governed exclusively by, and interpreted in full accordance with, the internal laws of the State of Wyoming, United States, without regard to conflict of law parameters.
You explicitly submit to the exclusive personal jurisdiction of the state and federal courts located in Wyoming to resolve any legal matter. Any dispute shall first be subject to good-faith negotiation for 30 days. If unresolved, disputes shall be settled by binding arbitration administered in Wyoming, USA, in the English language.
If you are a consumer resident in the European Union, you may also bring a claim before the courts of your country of residence and may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
We may update these Terms from time to time. Material changes will be indicated by updating the "Last updated" date at the top of this page. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
